General terms and conditions for end users for orders and deliveries at a distance

As of March 2017
1. Scope

With the conclusion of the contract, for all mutual claims between the customer and the VCDS shop, these general terms and conditions in the version valid at the time of the respective conclusion of the contract are agreed.
2. Contractual partner

VCDS-Shop concludes contracts with natural persons with unlimited legal capacity who have reached the age of 18 (hereinafter referred to as “customer”).

Registration (i.e. creation of a user profile) is required to send an online order via the VCDS-Shop website. The registration data must be entered correctly and completely by the customer. Registration is only allowed in your own name.

If the offer of a person who does not meet the above requirements is inadvertently accepted by VCDS-Shop, VCDS-Shop is entitled within a reasonable period of time to declare withdrawal from the contract towards that person.
3. Conclusion of contract

By sending an online order (ie by selecting the product, filling in the requested data and confirming the order by the customer using the online form provided on the VCDS Shop website), by placing an order by e -Mail, fax or post as well as by telephone order, the customer makes a binding offer, which must first be accepted by the VCDS shop.

VCDS-Shop is not obliged to accept an offer from the customer. If necessary, VCDS-Shop will inform the customer immediately.

A contract for goods comes about through the actual delivery of the ordered goods, whereby an automated confirmation of the receipt of an order (i.e. the customer’s offer) is not a declaration of acceptance.
4. Right of withdrawal and return conditions (cancellation policy)
4.1. Withdrawal

The customer has the right to cancel a contract concluded with VCDS-Shop for goods or services within fourteen days without giving reasons.

The cancellation period is fourteen days from the day on which the customer or a third party named by him, who is not the carrier, took possession of the goods. In the case of a contract for several goods that the customer ordered as part of a single order and that were delivered separately, the period begins on the day on which the customer or a third party named by him, who is not the carrier, the last Has taken possession of the goods.

In the case of a contract for services, the cancellation period begins on the day the contract is concluded (point 3.)

In order to exercise the right of withdrawal, the customer must inform VCDS-Shop by means of a clear statement about his decision to cancel the contract. This declaration must be sent to one of the following addresses:

The customer can use the model withdrawal form at the end of these terms and conditions, but this is not mandatory. This sample withdrawal form is also available for downloading and printing.

In order to meet the cancellation deadline, it is sufficient for the customer to send the communication regarding the exercise of the right of cancellation before the cancellation period expires.
4.2. Consequences of cancellation

If the customer withdraws from the contract, VCDS-Shop has all payments received from the customer, including the delivery costs (except for the additional costs that result from the fact that the customer has a different type of delivery than that offered by VCDS-Shop , cheapest standard delivery), to be repaid immediately and at the latest within fourteen days from the day on which the VCDS-Shop received the notification of withdrawal from this contract. For this repayment, VCDS-Shop uses the same method of payment that the customer used in the original transaction, unless expressly agreed otherwise with the customer. In the event that the payment method of the original transaction is not available for repayment (e.g. cash on delivery), the repayment will be made by bank transfer to a bank account specified by the customer. Under no circumstances will the customer be charged for this repayment.

VCDS-Shop can refuse the repayment until VCDS-Shop has received the goods back or until the customer has provided proof that he has returned the goods, whichever is the earlier.

The customer must return or hand over the goods to VCDS-Shop immediately and in any event no later than fourteen days from the date on which he has notified VCDS-Shop of the withdrawal from this contract. The deadline is met if the customer returns the goods before the period of fourteen days

1. General

VCDS-Shop.at attaches great importance to the protection of the data of every single customer.

The following statements refer exclusively to personal data that VCDS-SHOP.at receives from you as users of these websites or by telephone or written notification. Personal data will only be used to fulfill our contractual obligations or to the extent that you have given your consent. Personal data is used in accordance with the Data Protection Act 2002 (DSG 2000) and the Telecommunications Act 2003 (TKG 2003). 3. Collection, processing and use of personal data

3.1. What is personal data?

Personal data is the information that makes it possible to identify you personally. This includes in particular name, date of birth, postal or email address, VAT number, telephone or mobile number.

We only collect personal data if you voluntarily provide it to us during registration, during the ordering process, when registering for the newsletter or in the contact form. These details include: first and last name, company name, postal address, email address, date of birth and telephone number. For commercial customers, we also record the company address and the UID number.

3.2. What do we do with your personal data?

3.2.1. customer account

For every customer who registers accordingly, we set up password-protected direct access to his or her inventory data (customer account). Here you can view data about your completed, open and recently sent orders and manage your address data. You undertake to treat the personal access data confidentially and not to make it accessible to unauthorized third parties. We cannot accept any liability for misused passwords unless we are responsible for the misuse. After you have finished communicating with us, you should close the browser window or mobile applications, especially if you share the computer or mobile devices with others.

3.2.2. Use of data for contract processing

We collect, save and process your data for the entire processing of your order, the delivery of the goods and the processing of the payment, for any subsequent warranties, for our services as well as for technical administration and our own marketing purposes. We need your email address so that we can confirm your order and communicate with you. We also use this for your identification (customer login).

We save the text of the contract and send you the order data by email. You can view your past orders in our customer login area.

3.2.3. Use of data for advertising purposes – newsletter

If you register for our newsletter (click the checkbox in the registration process or fill out the newsletter registration form), we use the data required for this or separately provided by you in order to regularly send you our email newsletter.

By registering for the newsletter (clicking the checkbox in the registration process or filling out the newsletter registration form), you give your consent that we also use your data to inform you regularly about certain products, services or marketing campaigns by means of an email newsletter ,

If you later no longer wish to receive newsletters from us, you can object to them at any time without incurring any costs other than the transmission costs according to the basic tariffs.
